A apropriação social do espaço em áreas residenciais segregadas na cidade do Rio de Janeiro: o Projeto Rio e o Programa de Titulação Social na Favela da Maré

Abstract

This research has as main objective to analyze how the property titling process began, a legal instrument inserted in the Land Settlement Ordinance of Consolidated Informal Settlements, that occurred in the Set of Favelas of Maré between 1979 and 1984, through the implementation of the Sub-habitation Eradication Program (PROMORAR) that was known in Rio de Janeiro as RIO PROJECT. The central discussion is to analyze how the process of legalizing properties in the Maré area was completed after the Rio Project Program ended, analyzing how part of the residents obtained the definitive title of purchase and sale, as well as the total legalization of their real estate, through a process of regularization with the National Bank of Housing, the BNH, and the Secretariat of Patrimony of the Union, SPU, and for this will be used, as a reference, a property in particular for this study. This work is justified by the need to elucidate doubts regarding the legal situation of real estate after the termination of the RIO PROJECT, based on the case in particular analyzed, besides, of course, the contribution of another academic material related to the proposed theme. It is based mainly on documentary sources, taken from newspapers of the time, and in some fragments of the current legislation, as well as bibliographic sources on the subject, having as main reference the experience of this researcher as resident of the area in question.
