Os novos instrumentos do estatuto da Cidade e os processos de desapropriações

Abstract

The paper analyzes the application by the Municipal Government of some new and important urban policy instruments enshrined in the City Statute, especially the transfer of the Right to Build, as a form of compensation in the expropriation processes. Using legal, historical and doctrinal bases, the work intends to contribute to the debate around the theme, aiming to construct an alternative thought in face of the traditional procedure adopted by the municipal administrations, pointing out the institutional and legal means for the application of this instrument in order to make it possible for the expropriation to take place without charge to the public coffers.
