Estatuto da Cidade: uma lei inspiradora de novos desafios para a política urbana

Abstract

The process of urbanization is often analyzed in a way that is dissociated from social, economic, and cultural processes and relations. This conduct leads to mistakes and deviations from analysis and to the ensuing propositions, since the mutual influences between urbanization and social life are indisputable, a fact already evident in the industrial, cultural and political development of the nineteenth century. The regulations of Articles 182 and 183 of the Federal Constitution of 1988, in the decisive Chapter of Urban Policy, came about through Law No. 10,257 / 2001, called the City Statute. In this work it is argued that the edition of this Law officialized the birth of a new paradigm proposed to the public administration of the cities, based mainly on democratic management and mobilization for the fulfillment of the "Urban Rights", that is, the right to housing, , transportation, work, education, leisure, garbage collection, drainage of public roads and other services indispensable for social reproduction worthy of citizens. Thus, the paper analyzes the new challenges proposed for the effective implementation of the City Statute.
