Constitucionalização Simbólica no Direito à Moradia : uma análise da repercussão dos Jogos Olímpicos 2016 no Programa Minha Casa, Minha Vida

Abstract

The article proposes the problematization of the implementation of the "Minha Casa, Minha Vida" Program in the Municipality of Rio de Janeiro between 2009 and 2016, during the preparation of the central areas for the 2016 Olympic Games, from the perspective of the concept of symbolic constitutionalization. To demonstrate the distortion of the constitutional principles related to the fundamental right to housing, the historical inclusion of the mentioned right in the constitutional list and the normative construction of the MCMV are briefly presented. Afterwards, the implementation of the program in the Municipality of Rio de Janeiro during the mentioned period is detailed through norms, institutional materials, and presentation of cases. Finally, the idea of symbolic constitutionalization is detailed in the sense of constitutionalization-alibi and related to the performance of the municipal administration in the mentioned episodes.
