Resumo

This dissertation aims to investigate how the category of justice is mobilized by Black movements in contexts of human rights violations. To this end, an empirical, qualitative case study was conducted based on the observation of the “Carrefour Case.” In this sense, the research seeks to understand what it means to achieve justice in cases like the one analyzed, with the goal of identifying the role of criminal law as a means of combating impunity, as well as the inherent limits of justice as a reparation category. To accomplish this, the study adopts the framework of modern penal rationality, as it emerges as the most suitable theoretical reference for understanding the punitive logic underlying the Brazilian criminal justice system. In addition, intersections with psychoanalytic categories were established in an attempt to comprehend the demands for justice in the face of collective traumas.
