Os planos diretores em pequenos municípios no Brasil: realidade e perspectivas a serem concretizadas como instrumento de direito urbanístico

Abstract

Explore the issue of urban planning, focused on small towns in Brazil. In Brazil there are about 3852 small municipalities with up to 20,000 inhabitants. These, 3218 are not included in the Estatuto da Cidade (Law 10.257 / 2001) the obligation to fulfill the main basic instrument of urban policy in Brazil: the Master Plan. The requirement is expressed mainly for municipalities with more than 20,000 inhabitants. According to the IBGE, 58% of Brazilian citizens units are outside the basic planning process. Within the universe of small municipalities, 51% are without the basic tool of Brazilian urban law. In this sense, the absence of a municipal master plan as the basic mechanism of urban law sets a framework and deregulation of legal precariousness of the Brazilian State over 35% in all Brazilian cities.
